В статье освещены отдельные проблемы прокурорского надзора и расследования преступлений в местах лишения свободы. Определена роль Генеральной прокуратуры Российской Федерации и ее территориальных подразделений в соблюдении принципа законности в уголовно-исправительной системе России как заключенными, так и сотрудниками Федеральной службы исполнения наказания. Поднята проблема высокого уровня латентности преступлений и иных нарушений законодательства России в местах лишения свободы. Сформулирован вывод о том, что основным субъектом противодействия выявлению преступлений в местах лишения свободы являются именно сотрудники исправительных учреждений. Основная категория преступлений, совершаемых данными лицами - это превышение должностных полномочий, в том числе сокрытие факта их совершения. Авторами обозначена задача совершенствования методик и форм прокурорского надзора и расследования преступлений в местах лишения свободы. Внесено предложение об изменении процедуры направления письменных обращений заключенных в адрес сотрудников прокуратуры, отмечена необходимость реализации личных приемов прокурором граждан, содержащихся в местах лишения свободы, на постоянной, регулярной и конфиденциальной основе.
The article highlights certain problems of prosecutorial supervision and investigation of crimes in places of deprivation of freedom. The role of the General Prosecutor's Office of the Russian Federation and its territorial divisions in supervising the principle of legality in the criminal correction system of Russia is determined by both prisoners and officers of the Federal Penitentiary Service. The problem of a high level of latency of crimes and other violations of the legislation of Russia in places of deprivation of freedom has been raised. The conclusion is made that the main subject of counteraction to the detection of crimes in places of deprivation of freedom are the employees of correctional institutions. The main category of crimes committed by these persons is the abuse of authority, including the concealment of the fact of their commission. The authors outlined the task of improving the methods and forms of prosecutorial supervision and investigation of crimes in places of deprivation of freedom. A proposal is made to change the procedure for sending written appeals of prisoners to prosecutors, the need for personal receptions by the prosecutor of citizens held in places of deprivation of freedom on a permanent, regular and confidential basis is noted.
