ENSURING THE RIGHTS AND FREEDOMS OF CITIZENS DURING PROSECUTOR SUPERVISION OVER THE PRELIMINARY INVESTIGATION AND INQUIRY BODIES

Abstract

Within the framework of this article, one of the types of prosecutorial supervision provided for by the Federal Law ‘On the Prosecutor's Office of the Russian Federation’ was examined, and an analysis of supervisory documents was carried out. In order to improve the legislation, the author proposes to make some changes to the Code of Criminal Procedure of the Russian Federation (Code of Criminal Procedure), expanding the procedural powers of the prosecutor, giving him the right to issue a reasoned decision to institute criminal proceedings and subsequently refer the criminal case to the investigative or inquiry body to organize further investigation and make final legal and informed decision. Moreover, the author justifies the need for such changes to the Code of Criminal Procedure of the Russian Federation to fully and comprehensively ensure the rights and freedoms of citizens during prosecutorial supervision of the activities of bodies conducting preliminary investigations and inquiries based on statistical data.
